1. Nature of the Platform

BookMyVessel.com (“BookMyVessel”, “we”, “us”, “the Platform”) is a business-to-business (B2B) online marketplace that only connects Exporters/Importers (“EXIM”) with Freight Forwarders (“FF”). The Platform exists to help EXIM users discover competitive freight pricing and to help Freight Forwarders gain visibility and grow their revenue. BookMyVessel is solely a technology facilitator and is not a freight forwarder, shipping line, carrier, customs broker, logistics provider, agent, or party to any transaction, contract, or arrangement between users.

2. No Liability of BookMyVessel

BookMyVessel shall, under no circumstances, be liable for any loss, damage, claim, cost, delay, or expense of any kind arising out of or in connection with any dealing between an EXIM user and a Freight Forwarder. This includes, without limitation:

• Any financial loss, non-payment, overpayment, fraud, or commercial dispute between the parties;
• Any loss of, damage to, mis-delivery, theft, or delay of cargo, goods, documents, or shipments;
• Any incorrect, incomplete, misleading, or fraudulent information, quote, rate, or document provided by any user;
• Any direct, indirect, incidental, consequential, special, punitive, or exemplary damages whatsoever.

All transactions, negotiations, contracts, and shipments are entered into directly and exclusively between the EXIM user and the Freight Forwarder, entirely at their own risk and responsibility.

3. No Financial Responsibility

BookMyVessel has no financial responsibility or obligation of any kind in respect of any payment, refund, deposit, freight charge, demurrage, detention, penalty, duty, tax, or any monetary matter exchanged between users. Payments made to the Platform are strictly limited to subscription / plan fees for access to the Platform’s features and are governed by Clause 7. The Platform does not hold, guarantee, escrow, or process freight payments between EXIM and FF.

4. No Responsibility for Disputes

Any dispute, disagreement, claim, or grievance between an EXIM user and a Freight Forwarder — whether relating to pricing, service quality, delays, cargo, documentation, payment, conduct, or any other matter — is solely between those parties. BookMyVessel is not responsible for resolving, mediating, arbitrating, or compensating any such dispute, and shall not be made a party to it. Users agree to indemnify and hold BookMyVessel harmless against any such claim.

5. We Only Provide a Platform to Connect

Our sole role is to provide a digital platform on which the two parties can discover and connect with each other. We do not verify, endorse, guarantee, or warrant the accuracy of any listing, quote, credential, document, or representation made by any user, and we do not guarantee the performance, solvency, conduct, or legitimacy of any user. Users are solely responsible for conducting their own due diligence before transacting.

6. User Responsibilities

• EXIM users must provide accurate shipment details and independently verify a Freight Forwarder’s credentials before finalising any shipment.
• Freight Forwarders must hold all licences/registrations required by law, provide complete and transparent quotes with no hidden charges, and honour the terms they offer.
• All users must use the Platform lawfully, must not circumvent the Platform to defraud other users, and are responsible for the confidentiality of their account.

7. Subscriptions & Platform Fees

Freight Forwarders may purchase subscription plans to access lead and quoting features. Subscription fees are for Platform access and the effort BookMyVessel invests in operating the marketplace; they are non-transferable and non-refundable, as detailed in our Refund Policy. Plans may auto-expire and downgrade to the Free tier if not renewed.

8. Leads Are Indicative, Not Guaranteed

Any number of leads, enquiries, or lead allowances stated in a subscription plan is indicative only and is not a commitment or guarantee. BookMyVessel will use reasonable efforts to generate and distribute relevant leads to Freight Forwarders, but it does not guarantee, warrant, or commit to any specific volume of leads, enquiries, business, revenue, or conversions. Lead generation depends on factors outside BookMyVessel's control, including market demand and the activity of Exporters/Importers. The purchase of any plan is for access to the Platform's features and not a purchase of guaranteed business. No refund or claim shall arise on the basis that fewer leads or less business than expected were received.

9. No Off-Platform Contact Exchange

Users must not share or solicit any direct contact information — including phone/mobile numbers, email addresses, WhatsApp, or other personal contact details — within the free-text fields of a posted requirement, a quote response, or any message, prior to a contact exchange being mutually approved through the Platform. This protects both parties and the integrity of the marketplace. Any attempt to bypass the Platform or exchange contact details through these fields is a serious breach and may result in the immediate and permanent termination of your membership, and your company being restricted from registering or operating on BookMyVessel again, without refund.

10. Indemnity

Each user agrees to indemnify, defend, and hold harmless BookMyVessel, its directors, employees, and affiliates from and against any and all claims, liabilities, losses, damages, and expenses (including legal fees) arising out of that user’s use of the Platform or any transaction or dispute with another user.

11. Limitation of Liability

To the maximum extent permitted by law, BookMyVessel’s total aggregate liability to any user, for any cause whatsoever, shall not exceed the amount of subscription fees actually paid by that user to BookMyVessel in the three (3) months preceding the event giving rise to the claim.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy. A Freight Forwarder’s identity remains masked from EXIM users until both parties mutually agree to exchange contact details through the Platform.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. The courts at Faridabad, Haryana shall have exclusive jurisdiction over any matter arising from these Terms or the use of the Platform.

By registering for or using BookMyVessel.com, you confirm that you have read, understood, and agreed to these Terms & Conditions in their entirety.
